The lady and her friends claim the trattoria staff did not merit the 17-percent tip required of parties of 5 or even more. when talking of this case, who is right legally? Judge Napolitano discussed the legal implications in the case on today's Fox and Buddies.
Napolitano said there is not any categorical court ruling on this because the concept of adding tips is relatively new, but he explained that one argument made by the trattoria may be that it was not a tip, it was a surcharge that they were informed about previously.
From the other viewpoint, he claimed, "It has been a custom and convention in this country for hundreds of years ; you like the service, you leave a tip. You detest the service, you pay the bill and go, and the amount of the tip is to your own choosing."
Legally, he revealed the restaurant can't arrest these folk and hold them against their will. When referring to locking the consumers inside the bistro, the judge asserts that is called false imprisonment, so that the woman and her pals can technically sue the restaurant.
